ELECTRIC VEHICLE CHARGING STATION RULES
ADOPTED ON JANUARY 27, 2020
Pursuant to California Civil Code Section 4745(h), a homeowners association may install an electric vehicle charging station (“EVCS”) in the association’s common area for the use of all members of the association, and in that case, it must develop appropriate terms of use for the charging station. Accordingly, Surfside Association (“Association”) has created the following Electric Vehicle Charging Station Rules (“Rules”), and imposes the following requirements, relating to the use of the Association’s EVCS(s):
I. Usage Fee
The Association shall set the EVCSs pricing system, based upon the amount of charging time, amount of electricity consumed, time of day, day of the week, and/or other relevant factors based upon the Board of Directors’ discretion. The hourly or other rate, as determined by the Board, will be disclosed on the EVCS control panel.
II. Registered Users
Owners or tenants of the Association must register their vehicle(s) with the Association’s property manager to obtain permission to access all EVCSs on the Common Areas. Once permission is granted, the user will receive notification from ChargePoint, the Association’s EVCS management system (“ChargePoint”).

III. Visitors
Visitors of an owner or tenant within the Association are permitted to use the EVCSs. Each visitor will pay the same hourly rate as a registered user, in addition to a surcharge of $4.50, per use.
IV. Handicap EV Parking Spaces
The Association has designated two (2) Americans with Disabilities Act (“ADA”)- compliant parking spaces, one van-accessible, and the other, a standard ADA- compliant space. Fee
structure for the ADA-compliant spaces is the same as described under Article I, above. If all other EVCSs are in use, a registered user that does not possess a current handicap placard or specifically designated license plate, may park in the designated ADA space for the purpose of charging their vehicle. If a handicapped user places their name on the Waitlist, the registered user must vacate that EVCS space in fifteen (15) minutes or less. Failure to comply may lead to the user’s vehicle
being towed, and the imposition of a two hundred dollar ($200.00) fine, after notice and hearing.
Unregistered users parking in the handicap-designated EVCS space will be subject to the same enforcement procedure.
V. Designated Spaces
Upon registration, registered users will be assigned a specific EVCS. Should it be in use by another designated and registered user, and if another station is not in use, the registered user may take any vacant space. If the registered user arrives and their designated EVCS and space are occupied by an unregistered user, the arriving, registered user will inform the occupying user via Waitlist. The unregistered user of said space shall then move their vehicle within 15 minutes.
VI. Usage Time
The maximum connection time allowed on Association EVCSs is four (4) hours. A one- half hour grace period is allowed to disconnect and move the vehicle. Once the grace period is over, a six dollar ($6.00) per hour penalty will be charged. If there are vehicles on the Waitlist and the vehicle has not been moved in three (3) hours, the Association may have the vehicle towed at the user’s expense.
All users are expected to utilize their discretion and employ courtesy while using a EVCS space. Users should be mindful that, while others are on the Waitlist for a particular space, EVCS etiquette may require the user to limit charging time, which may mean unplugging and removing the vehicle when it is not 100% charged.
VII. Waitlist
The Association waitlist lets drivers get in line when all charging spaces on site are busy. It notifies all drivers when a charging spot becomes available, and notifies them of the time the space will become available.
VIII. Unauthorized Usage
Absolutely no non-EV vehicles may use the designated EVCS parking spaces, unless
authorized by the Association, its administrator, or its property manager in advance. Failure to comply may lead to towing and a two hundred dollar ($200.00) fine, after notice and hearing.
IX. Liability and Indemnification
All owners and tenants, as applicable, are responsible for ensuring that their visitors/guests abide by these Rules and the Association’s other governing documents, whenever utilizing the Association’s EVCSs. Users are responsible for their own personal safety and the security of their vehicles within the Association. The Association shall in no way be considered an insurer or guarantor of safety or security of EVCS users within the Association, nor shall it be held liable for any loss or damage caused by
the use of an EVCS or otherwise. No representation or warranty is made that the EVCSs, including all connections and components, will in all cases and at all times be functioning/operable.
If, at any time, an EVCS become non-operational, falls into disrepair, or may be deemed a nuisance under the Association’s governing documents, the user is to notify the Association’s property manager immediately, at which point, the Association and its agents must be allowed to access the EVCS to effectuate repairs and prevent any damage to the common areas. The cost of such repairs, if such repairs are deemed the responsibility of the user, will be charged to the user in the form of an assessment in accordance with the Association’s governing documents and California Civil Code Sections 5600-5740. If the user is a visitor, guest or tenant of an owner, said costs will be charged to the owner.
X. Miscellaneous
All vehicles utilizing a EVCS space must be parked so as not to obstruct an adjacent space.
It is prohibited to use any EVCS space as a storage area.
Only passenger electric vehicles may use an EVCS space.
Residue, stains and/or other damage of any kind caused by a vehicle upon a EVCS space will be subject to fines and/or the cost of cleanup and repairs. If the vehicle owner is the tenant, guest or invitee of an owner, that owner will ultimately be held responsible.
XI. Enforcement
Failure to comply with any of the Association’s governing documents, specifically, these Rules, may result in the offending vehicle being cited and/or towed at the vehicle owner’s expense.
The Association shall have the authority to remove any vehicle within the Association parked in violation of the Association’s governing documents, specifically, these Rules, in accordance with the provisions of California Vehicle Code Sections 22658 et seq. and any amendments thereto. The owner may also be assessed a penalty for their noncompliance or the noncompliance of owner’s tenants, lessees, guests, invitees, and other residents, with the Association’s governing documents, specifically these Rules.
